Obama DOJ OK’s Sec. of State Clinton’s Saxbe Fix

As would be expected, the Justice Department’s Office of Legal Counsel (OLC) has given its stamp of approval to the constitutional dodge popularly known as the “Saxbe Fix.” This is a ploy used with increasing frequency to evade the Constitution’s seemingly explicit emoluments, or ineligibility, clause. That clause (in Article I, Section 6) says that no member of Congress shall be named to any job “the emoluments [salaries] whereof shall have been increased during his term.”
