Minnesota’s Attorney General is defending the state’s regulation of political robocalls, according to this Minnesota Public Radio report.
The American Future Fund political action committee is challenging Minnesota’s law, arguing that the Federal Election Campaign Act preempts the statute. The Iowa-based group believes robocalls allow candidates with limited funds to reach a large number of voters.
The request submitted to the Federal Election Commission and comments are available on the FEC’s website under pending advisory opinions (Advisory Opinion 2009-27). As of the time of this writing, the only comments online are those joint comments from Shaun Dakin of Citizens for Civil Discourse and the National Political Do Not Contact Registry and former Indiana Attorney General Steve Carter.
