The D.C. Circuit announced its opinion in Unity08 and it’s available here.  The court upheld the district court’s holding that the Federal Election Commission’s advisory opinion was reviewable.  On the merits, the Court of Appeals  reversed, holding that “Unity08 is not subject to regulation as a political committee unless and until it selects a ‘clearly identified’ candidate.”
