Yesterday there was a hearing in Cao v. FEC. The report is here.
A federal judge on Wednesday left open the possibility that she will send a challenge of federal campaign finance laws directly to an appeals court for rulings on constitutional issues.
A Republican attorney had asked for such a move but Federal Election Commission attorneys defending the campaign finance law said that would be premature. In a brief hearing before U.S. District Judge Ginger Berrigan, attorneys for both sides agreed to work on a timetable to assemble information and file briefs before Berrigan decides whether the case should be sent to the 5th Circuit Court of Appeals in New Orleans.
