Express Advocacy

Earlier I noted that the California Fair Political Practices Commission was interested in hearing comments on what constitutes express advocacy under state law.  Now, staff issued a memorandum on the topic and concludes that it’s all green lights and blue skies for expanding the concept to communications beyond those containing the so-called magic words.

Meanwhile, the FPPC’s Subcommittee on Internet Political Activity is sharpening its regulatory claws and issued this report.
